Summary:This dissertation will evaluate anti-suit injunctions as a procedural remedy in international commercial arbitration before and after the West Tankers decision.' The anti-suit injunction was originally developed in the English legal system. In the past, it was mainly used in equity law to intervene in common law court litigation and preclude vexatious and oppressive litigation or a multitude of lawsuits.2 Today, anti-suit injunctions, in the context of arbitration, are used to restrain a party from beginning or continuing court proceedings when they agreed to arbitrate the matter in case of a dispute.
