Cross-border infrastructure is critical for regional integration and economic growth in the Southern African Development Community (SADC). Public-private partnerships (PPPs) are increasingly recognised as a viable mechanism for delivering such projects by leveraging private sector resources and expertise. However, the regional legal, institutional, and contractual frameworks of SADC have yet to sufficiently evolve to provide an enabling environment for cross-border PPPs to be used as a mechanism for infrastructure development. This research examines the current SADC legal framework governing cross-border PPPs, identifying gaps and challenges that hinder their use. Drawing lessons from regional case studies, including the N4 Maputo toll road project, T6 Katete Chanida road project, and Inga III dam, this study analyses how domestic and regional legal instruments interact to facilitate or impede cross-border collaboration. It further considers international experience from the Economic Community of West African States (ECOWAS), the European Union (EU), the Association of Southeast Asian Nations (ASEAN), and soft law in the form of international best practice, to propose legal reforms aimed at strengthening SADC’s framework. The findings underscore the need for harmonised, enforceable regional instruments and institutional capacity-building to enable sustainable infrastructure delivery through cross-border PPPs.
