Infertility is a prevalent issue in Zimbabwe. The main aim of this study is to determine the need for ARTs, as an infertility treatment option, in Zimbabwe and the way in which the law influences access to ARTs in Zimbabwe in order to improve access to them. A legal-doctrinal approach is employed to carry out this research by conducting a critical, qualitative analysis of legal materials that influence access to ARTs in Zimbabwe. The research also makes use of academic publications and online databases to inform this study. Although it is important to refer to judicial precedent to demonstrate how legislation and legal principals are applied and considered by courts, it is regrettable that Zimbabwe does not have case law on the issue. Thus, this paper considers judgements made in South African Courts. In this research it has been found that ARTs are an option for infertility treatment in Zimbabwe. However, there are legal, racial, cultural and biological factors that serve as challenges to accessing ARTs in Zimbabwe. Although these challenges exist, they are not permanent. Zimbabwe can draw good lessons from South Africa and Egypt so that ARTs are a recognized, available and accessible option for treating infertility in Zimbabwe.
