Imagine complementarity as a two-key system for a secure vault of international justice. The first key is held by the national legal system, the International Crimes Division of Uganda. If that key works perfectly - meaning the national system is genuinely and actively investigating and prosecuting the specific individual and conduct - then the vault stays closed to the second key. However, if the national key is jammed or broken, that is, unwilling or unable, only then can the International Criminal Court, the second key, step in to open the vault and ensure justice. The Kwoyelo case has over the years been testing Uganda’s national key to see if it truly unlocks the doors to justice on its own. The principle of complementarity, a cornerstone of international criminal law, dictates that national courts hold primary jurisdiction over international crimes, with the International Criminal Court acting as a court of last resort when states are genuinely unwilling or unable to prosecute.In response to the Lord’s Resistance Army conflict, Uganda established the International Crimes Division to domestically prosecute international crimes. This paper focuses on the Thomas Kwoyelo trial, Uganda’s first domestic prosecution of an international character, as a critical test of this commitment. Kwoyelo’s 15-year trial, however, was characterised by protracted delays, significant capacity limitations, including insufficient funding, judicial instability, and limited victim participation. Furthermore, the non-retroactive application of the ICC Act limited the scope of certain international crimes.
