The research explores the impact of the Constitution,1996 on the common law of contract. A limited study of the relationship between the principles and rules of the law of contract and the open-ended values underlying the Constitution is undertaken. This limited study extends to the nature and extent of the influence of chapter 2 of the Constitution on the law of contract. Finally, the approach of the courts in the application of the open-ended values of the Constitution to practical law of contract situations is analyzed.
