Technological innovations -- Law and legislation Business model innovation Commercial law Business planning UCTD Thesis (MEng) -- Stellenbosch University, 2022. ENGLISH ABSTRACT: Innovation is fraught with uncertainty and risk. It is subject to many external influences, including regulations from statutory bodies. A number of studies on the effects of regulation on innovation focus on specific examples in certain industries in certain countries at a certain time. This thesis suggests that a generalised macro view of the integrated effect of regulation on innovation may be of value to companies and policymakers alike. Presenting this in a framework format will be useful. The research methodology followed in this thesis is a qualitative, inductive process. A “first principles” approach is followed, starting with determining the basic functions of innovation. Technological innovation and business model innovation are then used to characterise the innovation practices of a firm. The fundamental functions that technological and business model innovation consist of are tested against a number of theories of value creation in order to determine if and to what extent these functions provide acceptable proxies for the innovation practices of a firm. The development of the framework is achieved through the analysis of two different sets of case studies where regulation has affected innovation. They vary in the nature of the type of regulation, the industry and country in which they are based. The case studies are analysed to determine which functions of technological and business model innovation are affected and how. The findings are then analysed and compared to confirm the validity of the framework. The study found that fundamental functions of technological and business model innovation are interrelated, and that they can provide an acceptable proxy for the innovation practices of a firm. The study also found that regulation does have an effect on the functions of technological and business model innovation, and that the effects can differ between different industries. The study indicates that through using the proposed framework, it is possible to provide a macrooutlook on the effects of regulation on innovation in an industry. The framework can be extended through further research to provide a richer and more nuanced interpretation of the impact of regulation on innovation.
