ENGLISH SUMMARY: The State is the custodian of mineral and petroleum resources as the common heritage of all the people of South Africa, for the benefit of all South Africans. This study’s primary focus is investigating and exploring the interconnectedness of ethical environmental governance, public participation and promotion of sustainable development in the EIA decision-making process, specifically in mining developments. A literature survey was explored to provide a theoretical framework for evaluating this. EIA regulations of the National Environmental Management Act 107 of 1998 (NEMA) prescribe minimum requirements for environmental impact assessment (EIA), and aid decision-making when evaluating development proposals for activities that are likely to have negative environmental impacts. The EIA decision-making process and its role players are discussed in detail in this study, together with duties and responsibilities in the EIA decision-making process. The legislative framework governing ethical environmental governance, public participation and sustainable development in the EIA decision-making for mining developments is unpacked in Chapter 3. The qualitative research methodologies supported this study’s exploration and investigation and assisted in gaining understanding on the different concepts and legislation. The case of Xolobeni Heavy Mineral Sands project will be addressed in this study to support the literature collected and give practical reference to the theory and legislation framework. The study concludes with answering the research question and proving recommendation for future mining development issues on the EIA decision-making process. AFRIKAANSE OPSOMMING: Die Staat se verantwoordelikheid is om mineraal- en petroleumbronne as gemeenskaplike erfenis te bewaar, tot voordeel van alle Suid-Afrikaners. Hierdie studie se primere fokus is om die onderlinge verband van etiese omgewingsbestuur, openbare deelname en bevordering van volhoubare ontwikkeling in die omgewingsimpakbepaling (OIB) besluitnemingsproses, spesifiek in mynbou-ontwikkelings, te ondersoek en na te vors. ‘n Literatuuropname is deurgesoek om ‘n teoretiese raamwerk vir die evaluering hiervan op te stel. OIB-regulasies in gevolge die Wet op Nasionale Omgewingsbestuur 107 van 1998 (NEMA) skryf voor wat minimum vereistes vir OIB is en gee bystand vir besluitneming wanneer ontwikkelingsvoorstelle evalueer word vir aktiwiteite wat waarskynlik negatiewe omgewingsimpakte sal he. In hierdie die OIB-besluitnemingsproses en sy rolspelers in detail bespreek, tesame met pligte en verantwoordelikhede in hierdie proses. Die wetgewende raamwerk wat etiese omgewingsbestuur, openbare deelname en volhoubare ontwikkeling in die OIB-besluitneming vir mynbou-ontwikkelings reguleer, word in Hoofstuk 3 uitgesit. Die kwalitatiewe navorsingsmetodologiee het hierdie studie se verkenning en ondersoek ondersteun, en begrip oor die verskillende konsepte en wetgewing bygestaan. Die geval van Xolobeni Heavy Mineral Sands-projek sal in hierdie studie aangespreek word om die versamelde literatuur te ondersteun en praktiese verwysing te gee vir die teorie en wetgewings-raamwerk. Die studie sluit af met die beantwoording van die navorsingsvraag en bewys van aanbeveling vir toekomstige mynontwikkelingskwessies oor die OIB-besluitnemingsproses.
