ENGLISH SUMMARY: Background: The healthcare services in South Africa are in crises due to the number of medico-legal claims and moneys paid out to claimants. The researcher, being a professional nurse practising in the medico-legal field, realised that such a nurse may play a valuable role as part of the legal team. However, the concept of such a nurse is not known in this country. Therefore, the purpose of this research was to investigate the role of professional nurses practising in the medico-legal field in South Africa. Methodology: A descriptive quantitative research methodology was applied, and data was collected through a self-report online questionnaire. The researcher developed a questionnaire to specifically investigate the role of the professional nurse practising in the medico-legal field in South Africa. A process to validate the questionnaire was followed and included peer reviews which demonstrated content validity in that the questionnaire measured what it was supposed to measure. A Cronbach Alpha coefficient was also calculated by a biostatistician for each subsection of the instrument. All results calculated more than 0.7 which indicated internal reliability of the instrument. Furthermore, a pilot study was conducted to support the reliability and validity of the research instrument and the research methodology. Ethics approval was obtained from the Health Research Ethics Committee of Stellenbosch University (S21/08/153). Ethical considerations, namely the right to self-determination, the right to confidentiality and anonymity, and protection from discomfort and harm, were taken into consideration. The population consisted of participants who were professional nurses living in South Africa and who were members of specialist nursing organisations, as well as attorneys involved in medical malpractice in South Africa. Unfortunately, participant numbers were limited as only N=69 participated of which n=13 were males and n=56 were females. Participants from the legal profession were n=16, from the nursing profession n=44, and n=5 participants were qualified in both professions. The participation numbers were very low for a quantitative study. The data was analysed through SPSS v.28. A biostatistician assisted to establish frequency tables. The Chi Pearson statistical test was mostly used to assess the relationship between the various variables and p-values indicate if a significant difference was found. Results: The results indicate that the objectives of the study were reached. The population was demographically described and most of the participants agreed about the requirements necessary for the professional nurse to practise in the medico-legal field. Differences in the views between the nursing and legal professions were identified and most of the participants agreed about the different roles of professional nurses practising in the medico-legal field, such as acting as an advocate or part of the legal team in medical malpractice claims. Conclusion: Advanced nursing practice in the medico-legal field in South Africa may be a specialty worth developing through advanced education. Further research is necessary to develop a curriculum compliant with educational purposes to enable the medico-legal nurse to practise according to identified requirements. AFRIKAANSE OPSOMMING: Agtergrond: Gesondheidsorgdienste in Suid-Afrika is in ‘n krises as gevolg van die aantal eise weens mediese nalatigheid en die hoeveelheid geld wat aan eisers uitbetaal moet word. Die navorser is ‘n professionele verpleegkundige wat in die regs-mediese veld praktiseer en het tot die besef gekom dat so ‘n verpleegkundige ‘n waardevolle rol as deel van die regsspan kan speel. Die doel van hierdie studie was dus om die rol van professionele verpleegkundiges wat in die regs-mediese veld in Suid Afrika praktiseer, te ondersoek. Metodologie: ‘n Beskrywende kwantitatiewe navorsingsmetodologie is aangewend en data versamel deur middel van ‘n self-rapporterende aanlyn vraelys. Die navorser het so ‘n vraelys ontwikkel, spesifiek om die rol van die professionele verpleegkundige wat in regs-mediese veld in Suid-Afrika betrokke is, te ondersoek. Om die geldigheid van die vraelys te bevestig, is ‘n portuur oorsig gedoen, wat aangetoon het dat die vraelys gemeet het wat dit veronderstel was om te meet. ‘n Cronbach Alpha koeffisient is ook deur ‘n biostatistikus vir elke onderafdeling van die vraelys bereken. Die resultate was almal hoer as 0.7, wat interne geldigheid van die vraelys aandui. Verder is ’n loodsstudie uitgevoer om die geldigheid en betroubaarheid van die navorsingsinstrument en die navorsingsmetodologie te ondersteun. Etiese goedkeuring is verkry vanaf die Health Research Ethics Committee van die Universiteit Stellenbosch (S21/08/153). Etiese aspekte wat aandag geniet het tydens die studie is die reg om self besluite te neem, die reg op konfidensialiteit en anonimiteit, en die reg om beskerm te word teen ongemak en benadeling. Die navorsingspopulasie was professionele verpleegkundiges wat in Suid-Afrika werk en lede is van ‘n spesialis verpleegkundeorganisasie, asook prokureurs wat in die regs-mediese veld in Suid-Afrika betrokke is. Ongelukkig was die getal deelnemers beperk tot N=69 waarvan n=13 manlik en n=56 vroulik was. Daar was n=16 deelnemers vanuit die regsprofessie was n=16, n=44 vanuit die verpleegprofessie en n=5 deelnemers wat in beide professies gekwalifiseerd is. Die getal deelnemers was dus laag vir ‘n kwantitatiewe studie. Die data is deur SPSS v.28 geanaliseer. ‘n Biostatistikus het hulp verleen met die opstel van frekwensie tabelle. Die Chi Pearson statistiese toets is meestal gebruik om die verhoudings tussen die verskillende veranderlikes aan te toon, en p-waardes het aangedui of die verskille betekenisvol was. Resultate: Die resultate toon dat die doelwitte van die studie behaal is. Die populasie is demografies beskryf en meeste van die deelnemers het saamgestem met die voorvereistes waaraan ‘n professionele verpleegkundige behoort te voldoen om in die regs-mediese veld te praktiseer. Die verskille tussen die verpleeg- en regsprofessies is geidentifiseer. Die meerderheid deelnemers het saamgestem met die verskillende rolle wat professionele verpleegkundiges, wat in die regs-mediese veld praktiseer , kan vervul: soos om as advokaat of voorspraak op te tree, of deel te wees van die regsspan in mediese nalatigheidseise. Slotsom: Verpleegpraktyk in regs-medies in Suid-Afrika, kan ‘n waardevolle verpleegspesialisasie veld wees wat verdere ontwikkeling en gevorderde opleiding noodsaak. Verdere navorsing is nodig om sodanige kurrikulum te ontwikkel ten einde die regs-mediese verpleegkundige toe te rus vir die vereistes wat in hierdie studie geidentifiseer is.
