ENGLISH ABSTRACT: The dissertation examines the problems hindering the administration of civil justice in Nigeria. It also explores the impact of court-connected alternative dispute resolution (CCADR) on the dispensation of civil justice in Nigeria. To this end, comparative, doctrinal and qualitative research methodologies were applied with a critical review of relevant primary and secondary sources of law. Data was collected from key stakeholders in Nigeria through unstructured interviews conducted with alternative dispute resolution neutrals, directors of the various multi-door courthouses (MDCHs) in six states, judges, and legal practitioners in Nigeria. The interviews were conducted to ascertain the effectiveness or otherwise of CCADR in Nigeria. The legal and institutional frameworks that promote the use of CCADR in Nigeria are examined, and the study further contains a comparative analysis of the impact of CCADR in the Republic of South Africa (RSA) and the United States of America (USA) with a view to drawing lessons aimed at improving CCADR in Nigeria. This study reveals that there are serious problems that hamper the administration of civil justice in Nigeria, primarily resulting in delays and clogged dockets. CCADR was adopted in 2002 by the Lagos State MDCH to address some of these problems. Currently, at least 20 out of the 36 states in Nigeria and all the federal courts have integrated CCADR into their civil justice system, borrowing heavily from the Lagos State MDCH. This research shows that the introduction of CCADR has contributed to the administration of civil justice in Nigeria and has the potential to significantly address most of the problems that plague the administration of civil justice in Nigeria if efficiently managed. In the USA, RSA, and Nigeria, CCADR was adopted to resolve the problem of delay in the administration of civil justice. The research reveals that since CCADR in Nigeria is fashioned after the CCADR programmes in the USA, Nigeria should take cognisance of the USA’s approach to funding, managing and sustaining its CCADR programmes for close to 50 years. The research also demonstrates that Nigeria can learn from the RSA, especially on how the Department of Justice and Constitutional Development annually reports on the various developments and shortcomings recorded on the court-annexed mediation (CAM) project. Finally, the research demonstrates that jurisdictions globally can learn from the failures and successes of the CCADR centres in Nigeria. This study ultimately recommends the adoption of sustainable funding and effective fiscal management policies, the introduction and effective implementation of national legal frameworks and policies, and the reform, redesign, and effective adaptation of the CCADR model in Nigeria, among others. This research is significant because it fits into the United Nations Sustainable Development Goal 16, which aims to promote peaceful and inclusive societies for sustainable development, provide access to justice for all and build effective, accountable, and inclusive institutions at all levels.
