Rooted in a historical context where apartheid imposed severe restrictions on Black South Africans—limiting access to land, education, political representation, and economic opportunities—the B-BBEE Act was instituted to redress these injustices and promote genuine economic transformation. Despite the Act's intention to foster inclusivity and equity, the pervasive issue of fronting undermines its objectives. Fronting involves deceptive strategies where businesses misrepresent their B-BBEE compliance, often by appointing token Black directors or falsifying ownership structures, to secure economic benefits reserved for genuinely empowered entities. Through a detailed examination of common fronting tactics and real-world case studies, the research highlights how these schemes adapt to regulatory changes, becoming increasingly sophisticated. It critically assesses the economic impact of fronting on both micro and macro levels, revealing how it distorts market dynamics and hinders sustainable growth. The study also scrutinises current mitigation measures, uncovering limitations in enforcement and compliance mechanisms that allow fronting to persist. By employing a robust theoretical framework, the thesis presents insightful recommendations aimed at curbing fronting. These include strengthening regulatory oversight, enhancing transparency in corporate governance, and fostering a culture of ethical business practices. The research emphasises that addressing fronting is not merely a legal obligation but a business imperative crucial for sustainable development and inclusive prosperity in South Africa. Ultimately, the thesis underscores the necessity of collective action among policymakers, businesses, and civil society to uphold the integrity of B-BBEE initiatives. It advocates for transformative strategies that go beyond superficial compliance, urging stakeholders to commit to genuine empowerment efforts.
