Parallel importation arises when a person purchases the products of a particular manufacturer abroad and imports the products into a country parallel with the authorized distributor in that country. The products are then sold in the country of importation in competition with the manufacturer or authorized distributor. There are several reasons why the parallel importer can offer his products at a lower price than the authorized distributor. These parallel imports then have a detrimental effect on the sales of the authorized distributor. For these reasons manufacturers and authorized distributors attempt to stop parallel importation. In this thesis the legality of parallel importation is investigated in terms of the principles of South African trade mark law, copyright law and competition law by means of comparative research. The comparative study focuses on American law and the law of Commonwealth countries such as Britain, Australia, Canada and New Zealand. On the basis of this research it is suggested that a trade mark is in general not infringed by the use of the trade mark on parallel imported goods. This conclusion is based on the function of a trade mark, i.e. to indicate the origin of the goods. Parallel imports are genuine goods and therefore the origin of the products is correctly indicated. Where the parallel imported goods have been changed after it was purchased abroad or where it is of a lesser quality than the products imported by the authorized importer or distributor, the parallel importation does infringe upon the rights of the trade mark holder. In the discussion of copyright as immaterial property right it is suggested that manufacturers and authorized distributors have had reasonable success in prohibiting parallel imported products embodying copyright. Because copyright can be territorially divided, it gives the owner thereof the power to control products embodying his copyright and to regulate the number of copies available in his territory. The fact that many parallel imported products do not embody copyright, is a shortcoming in the protection offered by copyright law. The law of competition also plays an important role in determining the legality of parallel importation. The actions of the parallel importer must by judged according to the boni mores. This affords our courts the opportunity to judge the possible unlawfulness of parallel importation in the light of various policy considerations. The courts have been reluctant to prohibit parallel imports, because that may promote monopolies and remedies under the law of competition therefore remain limited to those cases where the buying public may be deceived. In conclusion it is shown that the current South African statutory provisions and case law, developed along the lines followed in the United States and Anglo-Commonwealth countries, provide sufficient potential remedies against parallel importation.
