Vicarious liability is the liability of one party for the delict committed by another party. South African law recognises four categories of vicarious liability, arising from the relationship between the parties. The relevant relationships are: (1) employer and employee; (2) principal and agent; (3) car owner and driver; (4) partner with each other. The reason for vicarious liability for vicarious liability has to be sought in a number of policy considerations, not all of which are equally applicable to the different categories of vicarious liability. Substantial aspects are the creation of risk by the defendant in pursuit of his own interests and the possibility of loss distribution. It is important to distinguish between the reasons for and the rules of vicarious liability. Factors of legal policy are too vague to replace the common categories and cannot sufficiently explain the fine differentiations in the positive legal requirements. In this consideration lies the essential criticism against the adoption of the risk principle in the application of the law of vicarious liability. AFRIKAANSE OPSOMMING: Middellike aanspreeklikheid is, per definisie, die skuldlose aanspreeklikheid van een persoon vir die onregmatige daad van 'n ander. In die Suid-Afrikaanse reg word vier kategorieë van middellike aanspreeklikheid erken, in samehang met die verhoudings waaruit dit voortvloei. Die verhoudings ter sprake is: (1) werkgewer-werknemer; (2) prinsipaal-verteenwoordiger; (3) motorvoertuigeienaar-motorvoertuigbestuurder en (4) vennote onderling. Die regverdiging vir middellike aanspreeklikheid kan gevind word in 'n aantal beleidsoorwegings. Die belangrikste van hierdie beleidsoorwegings is die feit dat die verweerder 'n risiko skep ten einde sy eie belang te bevorder en die moontlikheid van skadeverdeling. Dit is belangrik om te onderskei tussen die regverdiging en die vereistes vir middellike aanspreeklikheid. Oorwegings van regsbeleid is te wyd omlyn om die erkende kategorieë te vervang en is nie in staat om die fynere onderskeid in die positiewe regsvereistes te akkommodeer.
