The recent conflict between the Committee of University Principals and the Committee of University Teachers' Associations was the result of growing concern amongst academic staff about their role and position within the university structure. Academics at universities regard themselves as employees, albeit intellectual workers of a particular kind, who require access to necessary structures to resolve some of their individual and collective grievances. These structures do not necessarily have to be brought about by legislation but the stated need of academics must be recognised by university management and something must be done to accommodate this need. If university management fail to take action, legislation will be the only solution. Legislation will force university management to enter into negotiations with academic staff on grievances and related matters. It is the view of the State and of university management that by definition, it will not be in the best interest or the country or of the university system if the traditional role of academic university staff should change. The implication is that they would prefer not to have academic staff put under labour legislation. It is the view of the State that every individual university should decide on negotiations with their academic staff or not, and how far they are willing to let the academics partake in the management of the university. At this stage the State is not yet willing to apply such legislation to universities. Increasing pressure from university teachers associations may lead to a change in this attitude of the State. Both the State and university management emphasise the unique character of academic personnel as well as the fact that, because of this unique character, academics cannot he compared to workers who do fall under labour legislation. The question that arises is whether this argument, by both the State and university management to maintain the status quo of academic staff, is really valid.
