ENGLISH ABSTRACT: Minority protection and self-determination have been receiving the attention of both international law and constitutional law of states for a considerable time. The most widely accepted and most often quoted definition of the term "minority" is that by Capotorti. According to him a minority is "a group numerically inferior to the rest of the population of a state, in a non-dominant position, whose members - being nationals of the state - possess ethnic, religious or linguistic characteristics differing from those of the rest of the population and show, if only implicitly, a sense of solidarity, directed towards preserving their culture, traditions, religion or language." AFRIKAANSE OPSOMMING: Minderheidsbeskerming en selfbeskikking geniet al geruime tyd die aandag van sowel die volkereg dan die staatsreg. Die wydste aanvaarbare en mees aangehaalde definisie van die term "minderheid" is die van Capotorti.
