The Indian constitution is a dynamic document which was drawn up with the specific purpose of accommodating the economic and social transformation of Indian society. Included in the constitution is a justiciable bill of human rights. The document also contains a set of socioeconomic rights which have been taken up as non-justiciable directive principles of state policy in a separate section of the constitution. The directive principles set out the duty of the state in the socio-economic upliftment of Indian society and is viewed as the conscience of the constitution. The fact that the directive principles were not made justiciable resulted in the Indian supreme court initially underestimating the possible influence of these principles. Today this situation has changed and the directive principles play a central role in Indian constitutional jurisprudence. The real potential of directive principles was unlocked only when the supreme court came to the realization in the early nineteen eighties that the directive principles and the fundamental rights do not necessarily contradict each other. The court is now of the opinion that the directive principles and the fundamental rights are enmeshed in a symbiotic relationship in which the one supplements the other. The way in which the Indian supreme court uses the directive principles in order to give a wider interpretation of the fundamental rights, contributed to the high esteem in which the court is held by the majority of the Indian population. It also contributed towards the popularisation of the concept of human rights. The Indian experience shows that the incorporation in a constitution of non-enforceable socio-economic rights as directive principles, can have a huge impact on the constitutional jurisprudence of a country. If the courts have the necessary powers, and if they are ready to act in an innovative way, they can make a positive contribution towards the realisation of the socio-economic ideals set out in the constitution. The writers of a new South African constitution could benefit greatly from some study of the Indian constitutional experience. They should realise that the inclusion of socio-economic rights in a constitution can and should have much more than symbolic value. In this regard the Indian experience suggests that these unenforceable socio-economic rights can actually be implemented in several innovative ways. To avoid destructive conflict, the mechanisms for such implementation should be clearly set out in a new South African constitution. It would be dangerous to shy away from such a task in order to facilitate compromise. However, if the writers of a South African constitution can manage to avoid the mistakes made by the Indian constitutional assembly, socio-economic rights could play a dynamic part in the new South African constitutional jurisprudence and affect the lives of ordinary people in a positive way.
