M.) -- Universiteit van Stellenbosch, 1994. Criminal proceedings in South African law are mainly accusatorial in nature. Inherent in this procedural system are rights and principles ensuring due process and safeguarding the position of the accused. Should any of these rights or principles be disregarded or transgressed, an irregularity will be present in the proceedings. In this regard a dual classification of procedural irregularities can be made. The first category contains procedural rights and principles which are regarded as so fundamental to due process, that their negation leads to a failure of justice per se. Proceedings in which such a fatal irregularity occurs, is ab initio void. The second category contains rights and principles the negation of which only results in the setting aside of a conviction and sentence if it causes serious prejudice of the accused. In this work an identification of the relevant procedural rights and principles is made mainly from case-law. To illustrate the incidence of the above-mentioned irregularities, a survey is made of the procedure of questioning in terms of the Criminal Procedure Act 51 of 1977 when the accused pleads guilty (section 112) or not guilty (section 115), as well as the change of plea from guilty to not guilty (section 113). In this regard an example of an irregularity from the first category is excessive and unreasonable judicial questioning of the accused during explanation of plea in terms of section 115, to the extent that the reasonable person comes under the impression that the presiding officer is biased against the accused. In this way the fundamental procedural principle that the presiding officer must be absolutely impartial, is negated. A failure of justice per se follows, destroying the proceedings in toto. An example of an irregularity from the second category is when the presiding officer omits to question the accused in terms of section 112, thereby denying him the opportunity to put his account before the court in accordance with the audi alteram partem-principle. If the accused is seriously prejudiced hereby, a failure of justice follows, justifying the setting aside of his conviction and sentence. The importance of safeguarding the position of the accused within the accusatorial system of criminal justice should be evident from the above discussion. The criminal justice system should, however, never fail to appreciate its important function of inhibiting criminal behaviour in an effective manner. Overemphasis of the accused's procedural rights may impede this task. Suggestions are, therefore, made in order to reconcile these two opposing value-considerations within the criminal process. These suggestions are based on an active role for the presiding officer as protector of the accused's rights, while, at the same time, regulating the process in order to ensure the effective administration of criminal justice. In this regard it is important that all procedural guarantees contained in the Bill of Rights be adhered to.
