This enquiry stresses that contracts, apart from any broad social-economic functions that they may fulfil, operate as a mechanism for the realization of particular objects of the parties. The central focus of this investigation is on the legal relevance, if any, of a frustration of the contractual purposes of one or both of the parties. In Chapter II the question is asked whether the South African law, apart from traditional requirements for validity, requires an additional requirement of iusta causa. A historical analysis of the term Is given, followed by the treatment of this subject in the Dutch and German legal systems A investigation of the position in the South African case law shows the ideal of individual autonomy as paramount The motives which actuated the parties in contracting are relevant only when made part of the contract through a meeting of the minds. The next chapter concentrates on a exposition of the attitude of the South African law in regard to the determination of the content of the obligation The origin of the supposition as a term of the contract is summarized, after which it is identified as a term ex consensu. The conclusion is drawn that the supposition serves the purpose of accommodating the parties' motives within the contract. Aspects in regard to the role of the supposition are discussed in the following chapters. Chapter IV deals with the tendency to portray cases of common mistake as examples of contracts subject to a supposition The historical origin of this practice Is traced back to the doctrine of the implied condition formulated by Grotius Its later development and subsequent rejection in the Dutch law is discussed and coupled with a exposition of English law on common mistake. The application of the supposition under these circumstances is rejected for our law as being based upon a fiction of intention it's submitted that an independent doctrine of common mistake be introduced into our law. Chapter V takes account of the prevailing attitude towards the supposition as a term linking liability to an existing state of affairs or a past occurrence The need to accommodate changed circumstances results in the extension of the supposition to future events This application must be regarded as being based on a fiction, and must therefore be rejected for our law.
