Negotiations between the main political parties in South Africa have rs theta objective a new constitutional dispensation based on the rule of law. These parties agree that a Bill of Rights should be included in a new, sovereign and negotiated constitution. Administrative law is closely connected to a country's constitution. Therefore, it was considered essential to examine the influence of a Bill of Rights on South Africa's administrative law. In various countries the implementation of a Bill of Rights had drastic consequences for their administrative law. The method of interpretation of the Bill of Rights by the legislature, the executive and the courts played a fundamental role in this regard. In the light of the doctrine of parliamentary sovereignty, the South African courts presently give a literal interpretation to legislation. They see it as their primary duty to give effect to the intention of the legislature. In this dissertation it is argued that this approach will be wholly inadequate in the context of a new constitutional dispensation. Only when use is made of grammatical, systematical, purposive, historical and comparative methods of interpretation will the constitution be properly interpreted. It is recommended that the courts should not follow a literalistic approach, but should give effect to the spirit and broader purposes of the constitution. In this way the rule of law could piny an important role in the future development of administrative law. The legislature often confers subjective discretionary powers on the executive to make inroads on fundamental rights (public subjective rights). It is submitted that after the implementation of a Bill of Rights the granting of such powers will (in accordance with the rule of law) be constitutionally impermissible. Legislation which imposes limits on fundamental rights will furthermore only be valid if it complies with the three requirements of the principle of proportionality, namely suitability, necessity and proportionality. The rule of law furthermore prohibits the use of ouster clauses which aim at the prevention of judicial review of administrative acts. The validity of administrative acts can also be tested against the provisions of a Bill of Rights. Administrative acts which limit fundamental rights without statutory authority will be invalid. In this dissertation it is submitted that this will also be the case when, in the exercise of discretionary powers, there is a disregard for fundamental considerations contained in the Bill of Rights. If (valid) legislation authorizes limitations on fundamental rights, discretionary administrative acts in terms of such legislation must (in accordance with the rule of law) comply with the requirements of the principle of proportionality. Of course, administrative organs will have to comply with the procedural requirements (for example, the rules of natural justice and the furnishing of reasons for a decision) laid down in a Bill of Rights. However, it is demonstrated that other provisions in a Bill of Rights (for example, those that protect the procedural rights of an accused) could also have an effect on the procedural requirements which some disciplinary bodies will have to follow. Lastly, upon the implementation of a Bill of Rights, more emphasis should (in accordance with the rule of law) be placed on the objective control of the legality of administrative acts. Any individual should be allowed to challenge in a court of law the validity of governmental acts, despite the fact that such a person may not be able to prove an immediate interest.
